The regional fuel tax legislation provides that a regional fuel tax cannot be put in place in any region outside Auckland prior to 1 January 2021. This means despite interest from other regional councils, no regional fuel tax can be put in place prior to this date.
Any proposal from a regional council for a regional fuel tax is subject to ministerial discretion. The legislation provides the Ministers of Finance and Transport complete discretion in deciding on any proposal for a regional fuel tax.
On 24 October 2018, the Prime Minister Rt Hon Jacinda Ardern made a commitment to not implement any further regional fuel taxes during her time as Prime Minister.
The legislation provides flexibility for a future government to put in place a regional fuel tax outside Auckland.
There has been interest in whether regional fuel taxes have been considered outside of Auckland. In recent time information requests have been received for:
- communications between the Minister (or his Office) and councils about a regional fuel tax outside of Auckland
- communication between the Ministry and councils about a regional fuel tax outside of Auckland
- all communication for the last six months with the Minister (or his Office) about implementing a regional fuel tax outside Auckland, including briefings, memos, aide memories, meeting notes, letters, emails and reports.
To further transparency, information held by the Minister of Transport and the Ministry of Transport that falls within scope of these requests is publicly available.

The information includes information provided to the Minister of Transport by the NZ Transport Agency where it considered a regional fuel tax as part of Let’s Gets Wellington Moving.
